End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and PBP Enterprises (“Company”) governing your use of the mobile application My Guardian – SOS (the “App”).

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the App.

1. License Grant

PBP Enterprises grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this Agreement and Apple’s App Store Terms of Service.

You may not:

• Copy, modify, or distribute the App

• Reverse engineer, decompile, or attempt to extract the source code

• Use the App for unlawful purposes

• Interfere with or disrupt App functionality

All rights not expressly granted are reserved.

2. Purchases, Subscriptions, and Free Trial

The App offers the following purchase options:

One-Time Purchase

Basic SOS Access

Price: $3.99 (one-time payment)

Provides lifetime access to basic SOS features available at time of purchase.

Auto-Renewable Subscriptions

Monthly Plan

$3.99 per month

Automatically renews monthly unless canceled.

Annual Plan

$39.99 per year

Automatically renews yearly unless canceled.

7-Day Free Trial

Eligible users may receive a 7-day free trial when subscribing to a monthly or annual plan.

• The free trial begins upon subscription confirmation.

• You will not be charged during the trial period.

• Unless canceled at least 24 hours before the end of the trial period, the subscription will automatically convert to a paid subscription at the applicable rate.

• Only one free trial per Apple ID may be permitted.

3. Billing Terms

• Payment will be charged to your Apple ID account at confirmation of purchase.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

• Your account will be charged for renewal within 24 hours prior to the end of the current period.

• You may manage or cancel subscriptions in your Apple ID account settings after purchase.

• Any unused portion of a free trial will be forfeited if you purchase a subscription.

• Prices may change in the future and will apply at the next renewal period.

4. Safety Disclaimer

My Guardian – SOS is a personal safety assistance tool. It does not guarantee rescue, emergency response, prevention of injury, or protection from harm.

The App:

• Does not replace emergency services

• Does not guarantee GPS accuracy

• May fail due to battery depletion, hardware malfunction, signal loss, software error, or other factors beyond Company control

You use the App at your own risk.

In an emergency, contact local emergency services directly (for example, 911 in the United States).

5. No Professional Advice

The App does not provide medical, legal, or professional advice.

6. Privacy

Your use of the App is governed by our Privacy Policy, available at:

7. Limitation of Liability

To the maximum extent permitted by law, PBP Enterprises shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages

• Loss of data

• Personal injury

• Failure of emergency response

• GPS inaccuracies

Total liability shall not exceed the amount paid by you for the App or subscription in the prior 12 months.

8. Termination

We reserve the right to suspend or terminate access to the App if you violate this Agreement.

9. Apple-Specific Terms

This Agreement is between you and PBP Enterprises, not Apple Inc.

Apple is not responsible for:

• The App

• Maintenance or support services

• Claims relating to the App

Apple is a third-party beneficiary of this Agreement and may enforce this Agreement against you.

10. Governing Law

This Agreement shall be governed by the laws of the State of Oregon, without regard to conflict of law principles.
